These Terms & Conditions (“Agreement”) govern all travel planning and booking services provided by Near or Far Custom Travel, LLC (“Agency,” “we,” or “us”) to the client (“Client,” “you,” or “your”).
By booking travel services with Near or Far Custom Travel, you acknowledge and agree to the following terms.

I. Services Provided
The Near or Far Custom Travel acts as a professional travel advisor and booking agent. Our services may include:
• Consultation, research, and personalized travel recommendations
• Preparation of quotes and itineraries
• Booking of accommodations, flights, transfers, tours, and activities as requested and approved by the Client
• Recommendations for comprehensive travel insurance and facilitation of quotes (when available)
• Support from booking through post-trip follow-up with suppliers
We do not own, operate, or control the independent suppliers (airlines, hotels, tour operators, cruise lines, etc.) whose services we book on your behalf.

II. Payments & Fees
Professional Services Fee: A consultation and planning fee of $100–$775, depending on trip complexity, is due prior to proposal delivery. This fee is non-refundable and separate from supplier costs.
Supplier Payments: Deposits, final payments, and deadlines are determined by suppliers and will be communicated at the time of booking. You are responsible for meeting supplier deadlines; failure to do so may result in cancellation without refund.
Additional Agency Fees:
• Rebooking/change requests after final itinerary approval: $100 per request
• Emergency concierge assistance (within 72 hours of travel): $150
Currency: All payments are in U.S. Dollars unless otherwise specified. Currency exchange rates fluctuate, and we are not responsible for changes due to exchange rates, taxes, or supplier surcharges.

III. Cancellations & Refunds
Agency Fees: The Professional Services Fee and any Agency administrative fees are non-refundable.
Supplier Policies: All cancellations and refunds are subject to the terms and conditions of the respective suppliers. Refunds, if any, are processed by the supplier.
Chargebacks: By authorizing payment, you agree to these Terms & Conditions, including all cancellation and refund policies. In the event of a chargeback dispute, your signed acknowledgment will serve as proof of acceptance.

IV. Client Responsibilities
You agree to:
• Provide accurate and complete information (including legal names, passport details, loyalty numbers, preferences).
• Review all documents (invoices, itineraries, confirmations) and report any errors within 24 hours of receipt.
• Obtain all required travel documents (passports, visas, vaccinations, health certificates).
• Comply with all laws, regulations, and supplier terms while traveling.
All bookings are subject to supplier policies, and it is your responsibility to review and accept them. The Agency is not responsible for a Client’s failure to understand or comply with supplier terms.

V. Travel Insurance
Near or Far Custom Travel strongly recommends comprehensive travel insurance to safeguard your investment.
Coverage may include trip cancellation, delay/interruption, missed connections, baggage loss/theft/delay, emergency medical/dental, and evacuation.
If you decline coverage, you accept full responsibility for any financial loss.
We are not licensed insurance agents and cannot provide individualized coverage advice, but we can refer you to reputable insurance providers upon request.

VI. Changes & Amendments
Client-requested changes are subject to supplier availability, pricing, and policies.
The Agency may charge a $100 administrative fee per change request after itinerary approval.
Additional supplier fees or increased costs are the responsibility of the Client.

VII. Limitation of Liability
The Agency acts solely as an advisor and booking agent; we do not control the operations of any supplier.
We are not liable for supplier defaults, errors, delays, cancellations, accidents, injuries, weather conditions, pandemics, political events, or any circumstances beyond our reasonable control.
Limitation of Damages:
Our total liability shall not exceed the amount of Agency fees paid by the Client for the specific services giving rise to the claim.
We are not liable for indirect, incidental, or consequential damages.
Force Majeure:
The Agency shall not be liable for any failure or delay caused by events beyond its control, including but not limited to acts of God, natural disasters, strikes, civil unrest, terrorism, war, pandemics, or government restrictions.
Independent Contractor Status:
The Agency is an independent contractor. No partnership, joint venture, or employment relationship exists between the Client and the Agency.

VIII. Governing Law & Dispute Resolution (California)
This Agreement is governed by the laws of the State of California, without regard to conflict of law principles.
Mediation:
All disputes shall first be submitted to good-faith mediation in the county where Near or Far Custom Travel, LLC maintains its principal business location in California.
Venue & Jurisdiction:
If mediation fails, disputes shall be resolved exclusively in the state or federal courts located in Los Angeles, California. Both parties consent to personal jurisdiction in those courts and waive any objection to inconvenient forum.
Jury Trial Waiver:
To the fullest extent permitted by law, both Client and Agency waive the right to a jury trial.
Timeframe for Claims:
Any claim or dispute arising from services rendered must be filed within one (1) year after the completion of the trip or event giving rise to the claim.

IX. California Seller of Travel & Consumer Protections
Near or Far Custom Travel, LLC complies with applicable California Seller of Travel requirements.
• Registration: CST # 2055333-40
• The State of California requires that certain transactions be covered by the California Travel Consumer Restitution Fund (TCRF) for California residents booking through registered sellers of travel.
• Registration as a Seller of Travel does not constitute approval by the State of California.
If you are a California resident, you may request in writing to receive a copy of the Seller of Travel registration and TCRF notice.

X. Marketing & Communications
Client Likeness & Testimonials:
You grant Near or Far Custom Travel permission to use written feedback, reviews, or voluntarily shared photos for marketing purposes. No sensitive personal data will be disclosed without your prior consent.
Electronic Communications:
You agree that emails, online forms, and electronic signatures constitute valid authorization and acceptance of these Terms.

XI. Compliance with Travel Regulations
The Agency operates in compliance with applicable federal and California travel regulations.
Certain bookings may be subject to additional consumer protections depending on your place of residence.

XII. Additional Legal Provisions
• Severability: If any provision is held invalid, the remaining provisions remain in full force and effect.
• Updates: We may update these Terms periodically. Updates apply to new services and future bookings.
• Entire Agreement: This Agreement, together with the Client Agreement Form and supplier confirmations, constitutes the entire agreement between you and The Wistful Wayfarer.
• Assignment: You may not assign or transfer your rights without our written consent.
• Attorney’s Fees: In any action arising under this Agreement, the prevailing party may recover reasonable attorney’s fees and costs.
• Headings: Headings are for convenience only and do not affect interpretation.
• Survival: Provisions related to limitation of liability, governing law, and dispute resolution survive completion of services.
• Right to Refuse Service: We reserve the right to decline service to any Client who engages in abusive, threatening, or unlawful behavior.
• Travel Risk Acknowledgment: Travel involves inherent risks such as accidents, illness, crime, natural disasters, or political events. You assume all such risks.

XIII. Entire Agreement & Acknowledgment
This Agreement, along with any signed Client Agreement and supplier confirmations, constitutes the entire agreement between you and Near or Far Custom Travel, LLC.
By submitting payment, signing a Client Agreement, or authorizing bookings, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
